AEB’s portfolio of restricted party lists has been extended with the BIS Military-Intelligence End User List (MIEU List). This list is published by the Bureau of Industry and Security (BIS), which belongs to the US Department of Commerce. In case this list is relevant for your company, and you wish to include it into your AEB Compliance Screening software, you can license the MIEU List to your already existing content.
What is the meaning of the restricted party list?
The MIEU List contains specific intelligence services and reconnaissance organizations as defined in § 744.22 EAR.
The export, reexport or transfer (In-Country) of all items subject to the EAR (as per § 734.3 EAR) is subject to a license requirement if there is knowledge of an “military-intelligence end use” or destined for a listed end user.
As a result, all transactions involving products listed in the Commerce Control List (CCL) as well as goods classified as EAR99 are subject to the license requirement of this regulation and may only be exported, reexported or transferred with a license.
Which companies need to screen against MIEU List?
The screening is recommended for all companies subject to US regulations. Your company may be subject to US regulations in case you are a subsidiary of a US company, or in case you have manufacturing sites in the US, or items that are subject to the EAR. You may also have to screen against this restricted party list as part of contractual obligations.
Do you need to license this list if you use third-party content in Compliance Screening?
If you screen your business partners against restricted party list content from third parties (such as Reguvis or Dow Jones) in your AEB Compliance Screening application, the MIEU List may already be included in your content. In that case you do not need to license this list separately/additionally. For more information, please contact your content provider directly.
